1. Definitions
In these Terms and Conditions, the following words shall have their associated meanings:
"Company," "our," "us," or "we" means Why Not Adventures Ltd.
"Contract" means the agreement between us and you which comprises these Terms and Conditions, the Tour itinerary, the booking form, and the Travel Risk Acknowledgement.
"Departure Date" means the date of commencement of the Tour.
"Terms and Conditions" means these terms and conditions.
"Tour" means the tour and related activities as set out in the tour itinerary.
"Traveller" or "you" means the person whose signature and details appear on the booking form.
"Tour Leader" means the representative of Why Not Adventures who accompanies the Tour to coordinate and oversee the trip on our behalf; not to be confused with any local guide or third-party supplier staff.
"Unforeseen Event" means an event or circumstance that is outside of either party's reasonable control.
2. General Website Terms
By accessing and using this website, you agree to be bound by these Terms and Conditions.
All content on this website, including but not limited to text, graphics, images, and information, is the property of Why Not Adventures and is protected by intellectual property laws.
You may not use, reproduce, distribute, or publicly display any content from this website without prior written permission from Why Not Adventures.
We reserve the right to modify, suspend, or terminate any part of the website or services at any time without prior notice.
3. Information About Us and How to Contact Us
We are Why Not Adventures, a company registered in the United Kingdom. Company No. 15826857.

If we need to contact you, we will do so by telephone or by writing to the email or postal address you provided in your booking form. “Writing” includes emails.
4. Our Contract with You
Travellers can secure their place on our tours by booking directly through our website and paying the non-refundable deposit.
A binding contract between you and Why Not Adventures comes into effect once the deposit has been successfully paid and you have received a booking confirmation email from us.
Our acceptance of your booking is conditional upon you:
- Confirming your acceptance of these Terms and Conditions;
- Paying the non-refundable deposit as specified.
We reserve the right, at our sole discretion, to refund your deposit and cancel your booking. If this occurs, we will notify you promptly.
5. Booking and Payment
All bookings must be made via our website.
A non-refundable deposit is required at the time of booking to secure your place on the tour.
The remaining balance must be paid no later than 60 days before the tour start date. Failure to pay the remaining balance on time may result in cancellation.
We reserve the right to cancel your booking and refund your deposit at our discretion.
6. Refund Policy
The deposit paid at the time of booking is non-refundable, except in the case where the tour is cancelled by the operator.
If you choose to cancel your booking more than 60 days prior to the Departure Date, you will be refunded the remaining balance paid, minus the non-refundable deposit and any administrative or other fees incurred up to that point.
Any cancellations made within 60 days of the Departure Date are non-refundable, and no refunds will be issued for any payments made.
We strongly recommend purchasing comprehensive travel insurance to protect against cancellation costs and unforeseen circumstances.
7. Passports, Visas, Insurance, and Health Matters
Why Not Adventures does not provide insurance, visas, or flights. It is your responsibility to arrange these.
It is mandatory to purchase travel insurance to cover any unforeseen circumstances on our trips. Insurance must cover all activities which you will partake in on the trip. We will advise if there is any non-standard coverage you need to purchase. You will be required to provide proof of insurance ahead of the trip departure date.
We will use reasonable endeavours to assist with visa applications, but you remain responsible for ensuring valid visas and health requirements before Departure Date.
Failure to provide proof of adequate insurance and visas may result in refusal to travel without refund.
8. Foreign and Commonwealth Office Advice
As a UK-based company, we monitor and follow travel advice issued by the Foreign, Commonwealth & Development Office (FCDO) for the destinations we operate in.
You are responsible for staying informed about the travel advice and entry requirements issued by your own country's relevant authorities. This may include government travel advisories, visa regulations, or health recommendations.
We will alert all travellers to significant FCDO updates or changes that affect our tours. However, it remains your responsibility to regularly check and comply with the travel guidance relevant to your nationality and residence.
- We are not liable for any cancellations or costs incurred if you decide to cancel your trip based on FCDO advice or equivalent advice from your country's government, unless we cancel the trip ourselves.
- We are not liable for any issues arising from your lack of adequate travel insurance or failure to comply with travel requirements from your own country or the destination country.
9. Tour Participation
Participants must be 18+ at Departure Date. Some trips may also have a maximum age limit. This will be mentioned on the trip page if applicable. We may verify age and decline participation if unmet.
Participants must ensure they are in suitable physical health for the activities included in the trip. If unsure, they should consult a medical professional prior to booking. Participation is at your own risk.
Participants must disclose medical conditions or dietary restrictions following booking.
We may remove participants from the trip without refund if their behavior is disruptive, threatening, discriminatory, or endangers themselves, others, or the group experience. This decision will be made at the discretion of the Tour Leader. In such cases, participants are responsible for any additional costs incurred as a result of their removal.
If a participant chooses to voluntarily leave the trip before its official end, they must notify the Tour Leader and sign a departure waiver. From the moment of departure, Why Not Adventures assumes no responsibility for the participant's safety, transport, accommodation, or any other costs incurred. All expenses and risks following their early exit are the sole responsibility of the participant.
10. Changes and Cancellations by the Operator
We reserve the right to make changes to the itinerary before or during the trip when necessary due to operational considerations or Unforeseen Events. These may include, but are not limited to, weather conditions, political unrest, natural disasters, transportation delays, or other circumstances beyond our control. In such cases, we will make every reasonable effort to deliver a comparable experience.
If we cancel a trip due to reasons within our control (e.g., logistical or staffing issues), you will receive a full refund of all payments made to Why Not Adventures. We are not liable for any other costs you may have incurred, such as flights or personal expenses. You may be able to recover these costs via your travel insurance.
If cancellation is due to Unforeseen Events (also known as force majeure), including but not limited to natural disasters, civil unrest, pandemic-related restrictions, or government-imposed travel bans, Why Not Adventures cannot be held liable for additional costs or losses. In such cases, you should make a claim through your travel insurance provider. Refunds or credits may be offered at our discretion.
Occasionally, a trip may not meet the minimum number of participants required to operate. If we cancel for this reason, you will be notified no later than 28 days before the scheduled Departure Date and will receive a full refund of any payments made to us. We may also offer the option to transfer to another trip or departure date.
11. Transfer of Tour by the Traveller
You may request to transfer your booking to a different trip or departure date, provided the request is made in writing at least 60 days before the scheduled Departure Date. All transfer requests are subject to availability and a non-refundable administrative fee of £100. If the cost of the new trip or departure date is higher, you will be required to pay the difference. If the new trip is of lower value, no partial refund will be issued.
You may also transfer your booking to another person (replacement traveller) no later than 30 days before the Departure Date, subject to our written approval. This person must meet all trip requirements and agree to these Terms and Conditions. An administrative fee of £100 will apply, along with any additional costs incurred due to the transfer (e.g., name changes with third-party providers). You remain jointly liable for all outstanding payments until fully paid by the new participant.
We reserve the right to decline a transfer request if it is made after the relevant deadline or if the proposed replacement does not meet the trip eligibility criteria.
12. Liability
Nothing in these Terms and Conditions limits or excludes our liability where such limitation or exclusion is prohibited by law, including liability for death or personal injury caused by our negligence, or the negligence of our employees, agents, or suppliers acting within the scope of their engagement.
Subject to the above, our total liability to you arising under or in connection with the contract for your tour — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall be limited to a maximum of twice the total amount you have paid for the tour.
We are not liable for any loss, theft, or damage to personal property, including luggage, cameras, mobile phones, or travel documents. You are responsible for arranging adequate travel insurance to cover such risks.
We are also not liable for any indirect or consequential loss, loss of enjoyment, disappointment, or emotional distress arising from the tour or any aspect of it. Furthermore, we do not accept responsibility for any injury, illness, damage, loss, or death resulting from:
- Force majeure or events beyond our control,
- Your own actions or omissions, including failure to follow instructions or safety guidance,
- The actions or omissions of third parties not directly connected with the provision of your tour, or
- Unforeseen circumstances or risks inherent to adventure travel.
You acknowledge that many of our trips involve physical activity and travel to remote or less-developed regions. By booking, you accept these inherent risks and agree to participate at your own risk.
13. Insolvency Protection
Why Not Adventures holds Financial Failure Insurance to protect your payments in the unlikely event that we become insolvent. This means that if we are unable to provide your tour due to financial failure, you may be entitled to a refund or repatriation (if applicable), depending on the circumstances and the coverage terms of the policy.
This insurance is designed to comply with your consumer protection rights and ensure peace of mind when booking with us. It is administered by a regulated third-party insurer and provides coverage specifically for the pre-payments you make to us for your trip.
Please note that this protection applies only to payments made directly to Why Not Adventures and does not extend to flights or additional arrangements you make independently.
14. Compliance with Legislation
All travellers are responsible for complying with the laws, customs, and regulations of the countries visited, including visa and immigration requirements. This includes, but is not limited to, respecting local cultural norms, following border and entry rules, and not engaging in prohibited activities.
It is your responsibility to ensure that all travel documents (passports, visas, permits, etc.) are valid and in order prior to departure. We are not liable for any issues arising from incorrect or missing documentation.
Any serious breach of local laws or behaviour that endangers yourself, others, or the integrity of the group may result in immediate removal from the tour without refund. In such cases, all onward travel arrangements and associated costs will be your responsibility.
15. Complaints
If you encounter any issues during the tour, you must raise them promptly with the Tour Leader so we can attempt to resolve the matter on the spot. Failing to give us an opportunity to address the issue at the time may affect your right to seek a remedy later.
If the issue remains unresolved during the trip, you must submit your complaint in writing to us within 7 days of the tour's completion. Include as much detail as possible, along with any supporting evidence.
We will acknowledge your complaint and aim to provide a response within 14 days. All complaints will be handled fairly and in good faith. Please note that we are not responsible for issues arising from third-party providers (such as airlines, accommodation partners, or local guides) where we act only as an intermediary.
16. Statutory Rights
Nothing in these Terms and Conditions affects your statutory rights under UK consumer law. As a consumer, you are entitled to certain protections, including rights relating to the provision of services with reasonable care and skill, the right to receive services as described, and the right to a refund or remedy if those obligations are not met.
If any part of these Terms is found to conflict with your rights under applicable UK legislation, such as the Consumer Rights Act 2015, those statutory rights will take precedence. These Terms are intended to work alongside, not override, the protections provided to you under the law.
17. Severability and Third-Party Rights
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.
No third party shall have any right to enforce any term of these Terms under the Contracts (Rights of Third Parties) Act 1999 or otherwise, unless expressly stated.
18. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. Changes to Terms and Conditions
We reserve the right to update or amend these Terms and Conditions at any time.
Any changes will be posted on this page with an updated revision date. It is your responsibility to review the Terms periodically to stay informed of any modifications.
20. Additional Terms for Travel to High-Risk Destinations (Including Iraq)
For trips to destinations where the UK Foreign, Commonwealth & Development Office (FCDO) advises against travel (including Iraq), you must carefully read and agree to the following additional terms:
- You confirm that you are fully aware of the travel advice issued by the UK Foreign, Commonwealth & Development Office (FCDO) for your destination prior to departure, and, if you are not a UK national or resident, you are also aware of any travel advice or warnings issued by your own government. You are choosing to travel despite any such advice or warnings.
- You confirm that you have purchased travel insurance that includes medical and repatriation cover, and that your policy covers all countries you are visiting and all activities you will be undertaking. You agree to provide proof of this insurance before departure.
- You understand and accept that we do not have cover for liability arising from war or terrorism risks on these trips.
- You understand that we do not provide crisis response cover for these trips.
- You acknowledge that, due to sanctions, no insurance payments will be made if doing so would breach applicable sanctions laws.
By booking a place on a trip to a high-risk destination, you confirm that you have read, understood, and accept these additional terms and the associated risks.
